Terms of use of the websites of TC Médias Livres, property of TC Médias Livres inc. ("TCMedia")

You should read these Terms of Use carefully before using the TC Media websites (the "Platform"). Any failure by you to comply with these terms of use may result in the termination of your account and the privileges you derive from it.

1. Acceptance of Terms of Use
1.1 If you choose to use the TC Media Platform, you acknowledge having read and understood these terms of use and thereby agree to comply with them as well as any changes that may be made to them. These Terms of Use constitute a contract between you and TC Media.

1.2 These Terms of Use may be subject to change, addition or deletion at any time. Any such change will be posted on this page; in addition, if we make material changes to the current terms of use, said changes will be posted at least thirty (30) days prior to their entry into force and our users who have provided us with their email address will be notified directly by email. You are requested to consult these terms of use periodically in order to be aware of any changes that may be made to them.

1.3 If you do not agree to be bound by these Terms of Use, you may not use the Platform. Additionally, if you find any of the changes to these Terms of Use unacceptable, you may terminate your account at any time.

2. Place of operation
2.1 TC Media operates its operations from its offices located in Canada and makes no representation to the effect that all elements of its Platform can be used in other locations. Thus, those who choose to use the TC Media Platform do so on their own initiative and it is their responsibility to comply with all laws applicable to them.

2.2 By using the Platform, you acknowledge and agree that these terms of use are governed by the laws applicable in the province of Quebec and that any dispute arising from or related to the use of the services and the Platform will be subject to the jurisdiction of the courts of the district of Montreal, province of Quebec.

 

3. Platform Changes
3.1 At any time, TC Media may modify, suspend or terminate any element of the Platform, including the availability of any function, database or content. TC Media may also impose limits on certain elements or restrict access to certain sections of the Platform without prior notice and without incurring its liability.

 

4. Personal use
4.1 All elements of the Platform are offered to you for personal use for non-commercial purposes. It is prohibited to use the elements of the Platform for commercial or advertising purposes.

 

5. Registration and security
5.1 When registering, you must choose a password and a user name. You may not (i) choose or use a person's password with the intention of impersonating such person; (ii) use a password in which another person has rights, without the authorization of such person; or (iii) use a password or username that TC Media in its sole discretion finds offensive.

 

5.2 You are responsible for maintaining the confidentiality of your password and username. You agree to keep this information confidential and agree not to disclose this information to anyone. It is strictly forbidden to exchange, share or communicate with a third party your information allowing you to register on the Platform. Thus, you agree to notify TC Media as soon as possible by email (soutien.technique@tc.tc) of any current or presumed use of your account by a third party, or of any breach or presumed breach of security in your account.

 

5.3 You are responsible for any use of the accounts you hold in relation to the Platform and TC Media cannot be held liable for unauthorized use of your account or for any loss or damage resulting in particular from non-compliance with the security measures set out to this section.

 

6. Fees and Payments
6.1 TC Media reserves the right to charge a fee for future access to its Platform, or any section thereof. If TC Media imposes new fees for access to any section of its Platform, rest assured that TC Media will notify you in advance and give you the opportunity to close your account before the said fees are imposed on you. 

 

 

7. Links

7.1 The TC Media Platform may contain links to third party websites. Activating these links may cause you to leave the Platform belonging to TC Media. Please be aware that TC Media has no control over third party websites. These sites are entirely managed by third parties and TC Media cannot make any representation whatsoever as to the quality or overall content of these sites or as to the quality of the products offered or the transactional security of the sites. in question. The fact that these third-party sites are listed on the TC Media Platform should in no way be interpreted as an endorsement by TC Media and in no way engages the responsibility of the latter. TC Media can in no way be held responsible for any damage caused by the use of these sites. Any complaints regarding third party sites should be directed to the administrators of those sites.

 

8. Intellectual Property

8.1 The trademarks and logos used or displayed on the Platform are trademarks and logos registered or not by TC Media or third parties. Nothing on the Platform may be interpreted in such a way as to allow, directly or indirectly, the use of said trademarks or logos without the prior written permission of their owner. Without limiting the generality of the foregoing, it is prohibited to reproduce the trademarks and logos displayed on the Platform for commercial or advertising purposes or to increase the volume of visitors to your site.

8.2 All elements of the Platform (including, without limitation, texts, articles, photographs, images, illustrations, audio and video extracts, software, etc.) are protected by copyright and belong or are authorized by TC Media or to third parties acting as content providers. Unless clearly stated exceptions, nothing on the TC Media Platform should be construed as granting you any rights with respect to TC Media or any third party intellectual property.

8.3 Except as provided in Section 9.4 hereof, you may not copy, reproduce, modify, publish, broadcast, distribute, participate in the transfer or sale of, create new works from, translate, download, license or in any way exploit any element offered on the Platform (including any software), in whole or in part. Thus, any use, or attempted use, of names, identities, addresses, emails, multiples, and or automated systems or programs, macro commands, scripts, robots or other systems or programs to registering or participating in any other way whatsoever, or to disrupt the use of the Platform, is prohibited and will automatically result in the withdrawal of the Platform access account, without notice.

8.4 You may download, reproduce or modify solely for educational purposes and in your teaching classes, the content of certain parts of the Platform on the understanding that such uses for educational purposes will be authorized only with groups of students. having purchased the resource in connection with the teaching material.

 

9. Representations and Warranties

9.1 You hereby undertake to defend and hold harmless TC Media, its directors, officers, directors, shareholders, employees, affiliated and related companies, its representatives and content providers, from any monetary condemnation in capital, interest, legal costs and extrajudicial damages and any other damages, including but not limited to, all reasonable legal costs incurred by TC Media relating to any claim, suit, action or formal demand ("Claim") arising from the non-compliance, by you or any other user of your account, of these terms of use. TC Media reserves the right to participate in the defense of any such Claim and to be represented by an attorney of its choice.

 

 

10. Limitation of liability

10.1 The Platform and all its elements are offered to you as is, free of charge by TC Media, without any guarantee, implicit or explicit, including, without limitation, guarantees relating to ownership, merchantability, fitness for purpose particular, the use, availability, validity, accuracy, reliability of the elements reproduced on said sites or as to the results resulting from the use of such elements. Without limiting the generality of the foregoing, TC Media makes no representations as to the exhaustive nature of the results of your searches performed on the Platform. You hereby acknowledge and agree that your use of the Platform is at your own risk.

10.2 TC Media makes no representations as to the accuracy or reliability of, nor endorses, any views, opinions, statements or other information posted and disseminated on the Platform by any user, content provider or other person.

10.3 TC Media declines all responsibility for any errors that may appear on the Platform. TC Media as well as any third party providing content on the Platform, their related companies, managers, employees, representatives or agents cannot under any circumstances be held liable for any damage directly or indirectly related to the use of the Platform, in particular the loss of data or profit resulting from the use of the elements of said sites, errors or omissions contained in the elements or the inability to use these elements, in particular for any technical failure of the networks, servers or suppliers or any other problem resulting directly or indirectly from a virus, a worm, a bug including, but not limited to, a congestion on the Internet network or in a website or a combination of both.

 

11. Termination

11.1 You can terminate your account by sending a request by email to the following address: clientele@tc.tc

11.2 TC Media may, at its sole discretion, terminate or suspend your account to all or any part of its Platform for any reason, including, without limitation, breach of these Terms of Use.
